Where site design calls for filling, dredging, or otherwise altering jurisdictional wetlands, the project moves from delineation into permitting. Florida's current regulatory framework requires separate but often concurrent authorization at the state and federal level. Environmental Resource Permits (ERPs), issued by FDEP or the applicable water management district (SJRWMD, SFWMD, SWFWMD), govern wetland impacts, storm water management, and surface water at the state level. Where impacts also affect Waters Of The United States (WOTUS), a Department of the Army (DA) permit from the U.S. Army Corps of Engineers is required, whether it’s a Nationwide Permit (NWP) for qualifying, lower-impact projects, or a Standard (Individual) Permit for larger or more complex proposals.
